Based on the developments and jurisprudence in #Cyberlaw in 2013, the author of this article seeks to make an intelligent guess on the trends that are likely to be important and significant in Indian #Cyberlaw in 2014.
Mobile crime is likely to increase by leaps and bounds in 2014. Presently, the total number of wireless subscribers is 87.54 crore in October 2013. However, with the rise in mobile users, cyber criminals are also increasingly targeting mobiles to commit their illegal designs as also targeting data. Indian Information Technology Act, 2000 is not yet well equipped to deal with all the challenges thrown up by emerging mobile crimes in India. Corporates in India are likely to witness breaches of their data in 2014 which would require urgent attention.
The dependence on OTTs like WhatsApp, Viber, We Chat etc are likely to further bring up complicated legal issues which will need appropriate consideration under the Indian Cyberlaw and mobile Law discipline in the year 2014.
As mobile banking and mobile payments continue to grow, there will be complicated legal and regulatory issues concerning mobile banking and mobile payments that will have to be appropriately addressed.
Given the lack of a definitive direction on cyber security, India is also likely to come across scenarios where it is likely to have to deal with issues pertaining to attacks and intrusions into its computer systems and networks from locations and powers located outside the territorial boundaries of India. All of the said activities have the potential of prejudicially impacting the sovereignty, integrity and security of India. Protection of Critical Information Infrastructure in India is important as cyber terrorists and cyber criminals could want to target the same for criminal designs.
As more and more governmental departments in India adopt the electronic format and make it mandatory, there are likely to be numerous ticklish and complicated electronic governance legal issues that are likely to engage the attention of Indian Cyberlaw as a discipline in the year 2014. Cyber terror and related jurisprudence are likely to be an important area of Cyberlaw in India in 2014.
