Judge Hears Arguments in Cigarette Warning Labels Case

WASHINGTON, D.C. – U.S. District Court Judge Richard Leon already blocked enforcement of the U.S. Food and Drug Administration’s (FDA) tobacco marketing and sale regulations, but the U.S. Department of Justice (DOJ) has requested that he reverse that decision, the Legal Times reports.

The government appealed Leon’s ruling, and an appellate court will hear the case in April. However, the DOJ wants the judge to support the rules because of Leon’s concern about caution to consumers and government encouragement.

FDA law, as passed by Congress in 2009, allows the agency to extend tobacco regulations to other tobacco products, including cigars and pipe tobacco. Currently, the FDA only regulates cigarettes, roll-your-own tobacco and smokeless tobacco products.

On April 25, 2011, the FDA issued a letter stating its intent to propose regulations on other tobacco products, such as cigars and pipe tobacco. The letter went on to state that these regulations may include company registration, product listing, ingredient listing, good manufacturing practice requirements, user fees for certain products and premarket review requirements for new tobacco products and modified risk tobacco products.

On June 22, 2011, the FDA published a final rule requiring nine text warnings and graphic images to be printed on the top 50% of the front and back of cigarette packages, the left 50% of the front and back of cigarette cartons and the top 20% of all printed cigarette advertisements. The new text and graphic-image warning labels were supposed to take effect by September 22, 2012.
