NORMAN, Okla. – I don’t smoke. I don’t vape. I’m no fan of inhaling anything other than air, except for maybe the occasional helium huff.
Nevertheless, I know people who smoke, who vape, and who have made the switch to vaping. I also see the plight of the millions of smokers who are unable to severe their ties to combustible tobacco.

When the FDA sent the finalized deeming regulations to the Office of Information and Regulatory Affairs (OIRA), part of the Office of Management and Budget (OMB) for the final review process on October 19, 2015, a 90 day clock began ticking.
OIRA review is limited to 90 days. That review period finished two weeks ago and it appears that an extension has been granted. There are two ways to extend the timeline; “the review period may be extended indefinitely by the head of the rulemaking agency; alternatively, the OMB Director may extend the review period on a one-time basis for no more than 30 days.”

WASHINGTON — On Jan. 28, President Obama signed the Child Nicotine Poisoning Prevention Act of 2015, legislation that “requires the packaging of liquid nicotine containers for use in electronic cigarettes to be subject to existing child poisoning prevention packaging standards.”
Senator Bill Nelson (D.-Fla.), who introduced the bill (S. 142), said, “Requiring childproof caps on these bottles is just common sense.”

An FDA adviser stated last week that he has yet to see any evidence that the coming crackdown on e-cigarettes is going to amount to prohibition. Still, this seems to contradict data that has been made public by the agency.
According to Dr. Thomas Eissenberg, a project director at the Center for the Study of Tobacco Products and a member of the Tobacco Products Scientific Advisory Committee, he has not seen any evidence that the new FDA regulations on vaping products is going to prohibit the sale of the items.

E-cigarette users should be concerned about proposed Food and Drug Administration regulations that may eliminate most brands of these potentially life-saving cigarette alternatives, leaving only those products marketed by large tobacco companies with the resources to complete expensive FDA applications.
