CRE Urges OMB to Support Judicial Review of Agency Data Quality Actions
CRE has urged OMB to assert its primary authority over implementation of the Data Quality legislation and guidance and take the position that final agency action rejecting a Data Quality petition is judicially reviewable. The June 17, 2005 letter points out how Department of Justice court arguments against judicial review are contrary to the plain language of the Administrative Procedure Act and U.S. Supreme Court interpretations of the APA. The CRE letter is in the form of comments on OMB's draft annual report to Congress on regulatory matters.
