Judge Made Rules On The Increase
CRE has initiated a program to critique four ongoing legal actions which are examples of Regulation by Litigation, i.e. use of the judicial system to bypass open, participatory, rulemaking processes. The critiques will be posted on its CyberActivist.US website. CRE is soliciting public comments on its program to publicize this unwarranted judicial intervention into agency rulemaking proceedings. To this end, CRE has sent a letter to attorneys of record of the cases critiques requesting their comments.
